The new global context reinforces the trend towards the establishment of national industrial policies, particularly in the US and Asia. The European Union responded by introducing a regime for the control of foreign subsidies and by evolving the state aid control regime. Member States have significantly increased their control over foreign investments and have blocked or modified numerous transactions, particularly in the energy and digital sectors. How can industrial policy and competition policy be best articulated in this new context?

The number of actions for damages and remedies is exponentially increasing across Europe while leniency applications are on the decline. In this context, what is the future of the leniency regime? The German Monopolkommission proposes to grant leniency recipients total immunity against damages and remedies. Other proposals are emerging to revitalize leniency policy, but doubts remain as to the feasibility of such an evolution.

While the EU courts appear to have embraced the effects-based approach to establishing abuses of dominance, the question arises of whether the standard of proof is not getting overly difficult to achieve following recent judgments such as Intel and Unilever. Is the bar too high for proving an abuse of dominance and, more generally, how can the effects-based approach be rendered administrable? Are the EU and the US approaches to enforcement in the field of unilateral conduct moving in the opposite direction, and where can they meet?
